JUSTrackz Ltd Acceptable Use Policy (‘AUP’) – last revised 01 Sept 2005
1. General
1.1. This AUP (which may be revised from time to time) applies to all use of services provided by JUSTrackz. Breach of this AUP may result in denial of access to / suspension of Services, termination, and civil and/or criminal liability.
1.2. We reserve the right in our sole discretion and acting in good faith to resolve any questions arising concerning the interpretation or application of this AUP.
2. JUSTrackz
2.1. We support the uncensored flow of information and ideas over the Internet and do not actively monitor subscriber activity under normal circumstances, except for measurement of system utilization, for the preparation of billing records, or as otherwise required by law.
2.2. We do not exercise editorial control over the content of any web site, e-mail transmission, newsgroups, or other material created or accessible over or through the services, except in the case of certain proprietary Web sites.
2.3. We nevertheless have a responsibility to take reasonable steps to ensure that all use of our services and facilities is lawful.
2.4. This AUP has been designed to ensure these obligations are met. We will therefore respond appropriately on becoming aware of unacceptable use of our service.
2.5. JUSTrackz may cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrongdoing.
3. Unacceptable Use
3.1. All uses which are
3.1.1. are illegal under any applicable law, or
3.1.2. are intended to or are likely to or which actually cause harm to any person, or
3.1.3. are intended to or actually interfere with the lawful activities or rights of any person, or
3.1.4. cause harm to or interference with the effective or efficient operation of any computer, network, or the internet or which are likely to encourage or enable or assist others to do such things, are unacceptable and therefore in breach of this AUP.
4. Examples of unacceptable use (this list is not exhaustive)
4.1. Illegality: storage or transmission of any material for illegal purposes, or in support of illegal activities, or where the material stored or transmitted is itself illegal
4.2. Harm to minors: storage or transmission of any material which may harm any minor in any way, including (but not limited to) child pornography
4.3. Threats: storage or transmission of any material that may threaten or encourage bodily harm or destruction of property
4.4. Harassment: storage or transmission of any material that may harass another person
4.5. Fraudulent activity: storage or transmission of any material to make fraudulent offers to sell or buy products or services, or in furtherance of any type of financial ‘scam’ such as ‘pyramid’ or MLM, ‘ponzi’ schemes, or ‘chain letters’
4.6. Forgery or impersonation: adding, removing or modifying identifying network header information; attempting to impersonate any person by using forged headers or other identifying information. (The use of anonymous remailers or nicknames does not constitute impersonation.)
4.7. SPAM - Unsolicited commercial e-mail / Unsolicited bulk e-mail: transmission of any unsolicited commercial or unsolicited bulk e-mail, other than (in the case of a newsgroup or mailing list) commercial messages that are appropriate under the rules thereof; storage or transmission of any spam supporting material; use of an email address or domain that is maintained on an JUSTrackz machine as reference or as a location of such activity
4.8. E-mail / News Bombing: use with intent to impede another person's use of electronic mail services or news
4.9. Unauthorized access: use without lawful authority to obtain or attempt to obtain access to data, or to the accounts of others, or to probe, penetrate, or attempt to penetrate, security measures of any computer software or hardware or telecommunications system or network
4.10. Copyright or trademark infringement: storage or transmission of any material that infringes any third party copyright, trademark, patent, trade secret or other proprietary rights, including, but not limited to, media files and software
4.11. Collection of personal data: use to collect, or attempt to collect, personal information about third parties without their knowledge or consent
4.12. Denial of service attacks: use which adversely affects (or is intended to adversely affect) the ability of other people or systems to use a computer or network or the Internet
4.13. Viruses: intentional distribution of software intended to cause damage, harassment, or annoyance to persons, data, and/or computer systems.
